Offers and orders :
If a buyer places an order of supplies with us or accepts one of our estimates, it is implied that he entirely adheres to our terms of delivery and payment.
We are only bound to the price we offer for our supplies for a period of 2 months from the date of our offer. Any additions to an order which has already been placed with us are subject to a new estimate from us, and, to be delivered or carried out, must be accepted beforehand under the same terms.
A down payment of 50% is required when the order is placed. If we do not receive this down payment and an order form signed by the customer, our company is not obliged to supply the goods.
An order may only be cancelled with our agreement. Special articles which are made to order, or have decoration, may in no way be taken back.
All orders entail the adherence to the following general terms of sale.
Delivery dates :
Delivery dates are only indicative, and their inobservance may in no way incur penalties or damages.
In the event of complaint or objection, the customer must inform us by registered letter within three days of the delivery of the goods.
To be admissible, it must be possible for us to state the validity of the claim, so that the necessary steps may be taken, if need be, with regard to those responsible.
Invoicing :
The prices indicated are established on the basis of current economic conditions, and do not include delivery charges. Delivery charges are payable by the buyer and are invoiced at the end of the order in addition to the products ordered.
The prices indicated on the price list are in Euros, do not include tax, and are ex works with invoiced packaging not taken back; unless specifically stated to the contrary. Our invoices are established at the date the goods are sent out.
If these terms must be altered for whatever reason (duties, taxes, exchange rates,…) the prices invoiced are likely to vary according to changes in these terms.
An invoice is drawn up for, and issued at the time of, every delivery, even partial deliveries.
Terms of payment :
All invoices are payable on reception.
Without previously obtained written agreement, non-payment of goods incurs an additional charge of 1.8% for every month overdue, and, if necessary, legal intervention.
The costs of legal intervention, overdue legal interest on judicial costs and compensation of 20% will also be applied.
Drafts sent for acceptance must be returned to us within 48 hours, in accordance with the provisions of commercial law.
If the latter is not observed, a protest may be drawn up through lack of acceptance.
The costs of returning unpaid drafts are always payable by the buyer.
We reserve the right to cancel without notice orders from a defaulting debtor.
On no account may the delay in transport or non reception of goods be cited by the customer to justify a delay in payment. The customer must take action against the carrier.
In the event of objection only the Versailles courts have jurisdiction.
Delivery and the transfer of risk.
Our goods travel at the risk of the consignee, even for deliveries without charge.
In the event of delay, loss or damage, all appeals must be made to the carrier (and noted on the delivery slip) on receipt of the goods and all reserves must be confirmed to the carrier by registered letter within 48 hours.
Returning goods :
In the event of a mistake in the order by the customer, an exchange will only be possible for perfectly packaged new goods, sent at the customer’s expense after written agreement on our behalf.
The credit note will take into account a fixed reduction of at least 10% in respect of costs incurred.
Right to reserves on ownership :
In accordance with law N°80.335 of 12 May 1980, goods legally remain our property until they are properly paid for by the customer.
The catalogue is owned by us and its contents may be modified by us at any time.
It does not, in any way, constitute a contractual document.
Our products have been registered with the INPI in the whole world and as a result, all reproduction is prohibited and liable to legal proceedings.
